Important Changes In Texas Residential Homestead Exemptions

Effective September 1, 2011, in order to qualify for a residential homestead exemption you must provide the following to the Central Appraisal District when submitting your application.

1) A copy the your Texas driving license or Texas identification card AND

2) A copy of of your vechicle receipt, OR

* If You don’t Own a Vehicle, you need to complete the Non‐Ownership of Motor Vehicle Affidavit on Page 4 of your homestead exemption application. This must be a sworn statement signed before a Notary Public. AND

* A copy of a utility bill for the homestead property showing the bill is in your name and the utility address matches the physical address of the homestead property.

Please Note. Your property address on the exemption application must match the address on your vehicle registration and both must match the address on your driver’s license or state ID card or utility bill. All three must have the same address. If they don’t match your exemption will not be approved by the chief appraiser.

A new holiday event for 2011 is “It’s a Wonderful Life in Newman Village” which will be from 6 to 9 p.m. on Dec. 2.  Newman Village is the master planned community off of Eldorado Parkway just west of the Dallas North Tollway. The event includes Hot Cocoa, ice skating rink (skates available), horse-drawn carriage rides, choo-choo train rides and a special visit from Santa.

About Newman Village

Newman Village is an upscale residential gated and guarded master planned community that when finished will house over 500 homes. Home prices will range from the $400,000s with custom home builders building in the million dollar range. Homes range in size from 3,000 to over 5,000 square feet.

Now that we are getting close to the end of the year prospective sellers are asking the question should I list my house now or wait until next year? The fear that sellers have is that their house will sit on the market during the winter and become stale.

Consider the following:

Is you home market ready?

The homes that sell the fastest in any market are those that are “move in ready” so if your home is not in the best condition maybe now is the time to fix some things.

What is your local competition?

Find out from your realtor how much competition there might be for your home if you were to put it on the market now. In your local area good home inventory may be low so it could be a good time to get your home on the market.

Less competition

Most sellers don’t put their home for sale the last couple of months of the year so the inventory of homes tends to be low. If you have buyers in your area, now may be a great time to list your home as Interest rates are low and competition is less.

Corporate Relocations

Corporations tend to move their staff in the 1st and 4th quarters of the year. The end of the year is also the time when corporations are taking stock of their year-end budgets and figuring out what is left to be spent in 4th quarter. Having your home on the market during the 4th quarter means you may pick up a relocated buyer.

So you are thinking you can sell your home yourself (FSBO or for-sale-by-owner), and save the commission you would have to pay if you used the services of a professional realtor, below are 6 things to think about first. 

1) FSBOs are not allowed to list their home for sale in the MLS (multiple listing service) because it is a industry membership organization and only available to licensed real estate agents & brokers. This also means that many websites and search engines including the most popular ones such as Realtor.comTrulia.com and AOL will not list FSBOs as they get their listings from the MLS.

2) Real Estate Agents and Brokers are less likely to show FSBO homes because the buyers agent receives a  percentage of the commission the seller pays to the listing agent. This percentage is agreed upon and shown in writing in the listing agreemement which is a legally binding document. So even if the FSBO says he will pay the buyers agent their commission their is no legally binding document in place so most agents won’t go through with the transaction.
3) Like many homeowners FSBOs usually overprice their homes because they believe that their home is worth more than comparable homes in the same neighborhood. The benefits of using a real estate agent is that they can provide a  Comparable Market Analysis (C.M.A) which will help you price your home competitively and provide tips for improving the home’s appeal.
4) Buyers will spend less time in a FSBO if the owner is present during the showings, and they will feel shy about discussing its good and bad points with their agent if the owner can hear them.
5) There are many legal issues in a real estate transactions and FSBO’s who overlook any of the legal disclosure requirements could find themselves in an expensive buyer lawsuit after the transaction closes.
6. Only 9% of home listed by FSBOs sell and of those that do the majority sell for 6% or more less than those sold using the services of a realtor.

Texas home-sales volume increases as prices hold steady in third quarter


For the period of July through September 2011, the volume of single-family home sales in Texas was 58,019, nearly 18% more than the same quarter in 2010. Real estate prices remained flat in the third quarter with the median price statically unchanged from Q3-2010 at $151,800 and the average price down less than one percent to $197,833, according to the latest Texas Quarterly Housing Report issued by the Texas Association of REALTORS®.

“We expected a significant jump in sales this quarter because, this time last year, sales were artificially low due to the homebuyer tax credit that pushed demand into the second quarter. Overall, we are thrilled by the performance of the market this quarter and believe these results illustrate the strength of Texas’ housing economy,” said Dwight Hale, chairman of the Texas Association of REALTORS®.

Jim Gaines, Ph.D., an economist with the Real Estate Center at Texas A&M University, also commented, “The market is starting to look like it did before the real estate boom and bust. Sales this quarter are comparable to levels in 2002 and 2003, indicating the market is returning to a more normal sales pace.”

Gaines continued, “Despite being behind the first half of the year, we expect the second half of 2011 to outperform last year, ending the year slightly higher than 2010.”

In addition, Texas had 7.4 months of inventory in the third quarter of 2011 compared to eight months in Q3-2010. That figure, driven down by the decrease in the number of listings, is considered to be the high point of a balanced market by the Real Estate Center.

“Listings were down in part due to fewer distressed properties on the market as Texas’ foreclosure rates declined in recent months,” Gaines explained. “While Texas does not have the backlog of foreclosures seen in many other states, we do still have some pending. As these distressed properties hit the market, we will probably see a fluctuation in inventory in the coming months.”

On Sunday, November 20th, The Shops at Legacy will kick-off the holiday season by hosting “The Lights At Legacy”, a fun-filled tree lighting ceremony enjoyed by Plano residents and surrounding communities. Organized by the Shops at Legacy, the tree lighting ceremony is a delightful holiday tradition featuring Santa and much more.

The celebration brings enticing activities for the entire family including live reindeers, carolers, face-painting, train rides, caricature artists and a visit from Santa Claus, all while various musical groups and choirs will perform on three different stages. Merchants will also be hosting a variety of activities including special promotions both inside and outside their stores, and great deals for attendees to start their holiday shopping.

At 6:30 p.m. we will kick off the holiday season and light the Christmas tree standing 60 feet tall with over 15,000 sparkling lights.

Proceeds will benefit Children’s Medical Center Legacy. The Shops at Legacy will also be collecting toys to donate to the Plano Christmas Cops. The Plano Christmas Cops program is celebrating its 25th anniversary and hopes to assist many families in need in the Plano area.

The festival kicks off at 3 p.m on November 20 with fabulous entertainment and events throughout the afternoon for all to enjoy and the tree lighting ceremony will begin at 6:30 p.m. For more information about the event, please visit the website.
